Welcome to HiFiSwap. These Terms of Service (the “Terms”) govern your access to and use of the HiFiSwap platform, including the website https://hifiswap.io/ and all related applications, tools, and services (collectively, the “Service”), operated by HiFiSwap and its affiliates (“HiFiSwap”, “we”, or “us”).

By accessing or using any part of the Service, you confirm that you have read, understood, and agree to be bound by all of these Terms. If you do not agree, do not use the Service.

1. Acceptance and Updates of the Terms

1.1These Terms take effect from the moment you access the website or use any of the Services. By doing so, you confirm that you reviewed and accepted these Terms before completing any registration process.
1.2We may revise these Terms at any time at our sole discretion. Revised versions will be posted on the website and take effect immediately upon publication. We may also notify you of changes by email or a website banner. Your continued use of the Service after a revision is posted constitutes acceptance of the updated Terms.
1.3It is your responsibility to review these Terms periodically. If you do not agree with any revision, please stop using the Service immediately.

2. Service Overview

HiFiSwap operates a non-custodial crypto-asset exchange platform. Through the Service, you can:

2.1Convert one crypto asset into another (an “Exchange”);
2.2Access an aggregated marketplace with rate comparison across integrated fiat service providers;
2.3Use decentralized exchange functionality for DeFi tokens.
2.4All Exchange transactions are executed by third-party liquidity providers on their respective blockchain networks. HiFiSwap does not hold, store, or custody your crypto assets at any stage of the exchange process.
2.5“Crypto assets” means digital assets that can only be transferred using blockchain technology, including digital currencies, tokens, and other digital media of exchange (such as Bitcoin, Ethereum, and XRP), and expressly excludes securities of any kind.
2.6Exchange rates displayed on the platform are estimates and may differ from quotes available through other channels. The final rate is determined at the time the transaction is executed and may differ from the estimate initially displayed.

3. Eligibility

Before using the Service and throughout your use of it, you must meet and continue to meet the following conditions. You represent and warrant that:

3.1You are at least 16 years old, or have reached the age of majority in your jurisdiction;
3.2You are not located in, a national of, or a resident of any jurisdiction that expressly prohibits crypto-asset trading, and you are not located in the United States of America or any of its territories (Puerto Rico, American Samoa, Guam, the Northern Mariana Islands, or the U.S. Virgin Islands), collectively the “Restricted Areas”;
3.3You use the Service of your own volition and at your own risk;
3.4You are solely responsible for determining and fulfilling any tax obligations that may arise from your use of the Service;
3.5Your crypto assets were legally obtained and belong to you, free of any security interests, encumbrances, disputes, or seizures, and no third party has any claim to them;
3.6You will provide accurate wallet addresses and transaction information, and such addresses are not involved in terrorism, fraud, or any illegal activity.

HiFiSwap reserves the right to choose the markets and jurisdictions in which it operates, and may refuse or restrict service to any user or region at its sole discretion.

4. Exchange Process

4.1To use the full functionality of the Service, you agree to comply with our AML/KYC policies where applicable. HiFiSwap may require additional identity verification or proof of source of funds at any time.
4.2Rate options:
4.2.1Floating rate — the final rate is determined when the transaction is processed and may fluctuate with market conditions.
4.2.2Fixed rate — the rate is locked when the order is created, protecting you from market fluctuations during the exchange.
4.3If market conditions change significantly after you initiate a transaction, HiFiSwap may process the exchange at the updated market rate, or, where it cannot proceed, refund the deposited crypto assets (less applicable fees). Refunds are usually processed within 1 to 7 business days after you confirm the refund address.
4.4User errors — For problems caused by user mistakes such as entering an incorrect wallet address, using the wrong blockchain network, or omitting a transaction memo or destination tag, our technical team will assist where technically feasible, subject to deduction of related fees and operational constraints.
4.5Once such issues are resolved, recoverable crypto assets will be returned to you after deduction of all applicable fees and operational costs. All refunds require your prior consent to the relevant deductions.

5. Fees

HiFiSwap is committed to fee transparency. The platform’s fee structure consists of two parts:

5.1Transaction fee — a service fee charged for executing your exchange.
5.2Network fee — a blockchain fee paid to miners or validators for processing and confirming on-chain transactions. This fee is determined by each blockchain network and may fluctuate at any time. The network fee shown when an order is created is an estimate, and the actual amount charged may differ.

6. Anti-Money Laundering (AML) & Know Your Customer (KYC)

HiFiSwap is committed to preventing money laundering, terrorist financing, and other illicit activity. We reserve the right to apply AML/KYC verification procedures to any user, wallet address, or transaction in accordance with our internal compliance policies and applicable law.

7. Prohibited Conduct

You agree that you will not, and will not assist or encourage any third party to:

7.1Use the Service in violation of any applicable law or regulation;
7.2Use the Service for fraud, money laundering, terrorist financing, or any other illegal activity;
7.3Exchange crypto assets derived from illegal gambling, theft, corruption, or other illicit sources;
7.4Provide false, misleading, or fraudulent information;
7.5Reverse engineer, decompile, disassemble, or otherwise attempt to obtain the source code of our software;
7.6Access the Service or extract data using bots, scrapers, crawlers, or other automated means without our written authorization;
7.7Circumvent any security measures, access controls, or content-filtering mechanisms used by HiFiSwap;
7.8Develop third-party applications that interact with the Service without our prior written consent.

8. Risk Disclosure

8.1HiFiSwap does not provide investment, financial, or legal advice. All exchange decisions are made at your own judgment and risk. Before making any exchange, you should independently assess whether the transaction is suitable for your financial situation.
8.2Crypto assets are inherently highly volatile and remain at an early stage of development both technically and in terms of regulation. Crypto assets are not necessarily protected or regulated by any government agency, and you should not expect the same safeguards as traditional financial products.
8.3The risk of loss in exchanging crypto assets can be substantial. You acknowledge and accept full responsibility for all risks and outcomes involved in using the Service.
8.4You further acknowledge that risks inherent in network systems (including hardware failures, software defects, and network outages), as well as risks specific to blockchain protocols (including protocol-level vulnerabilities, unexpected behavior, and network attacks), may affect your transactions.

9. Intellectual Property

9.1All intellectual property rights related to the Service — including but not limited to software, source code, trademarks, logos, interface designs, graphics, and content — are owned by or licensed to HiFiSwap and protected by applicable intellectual property laws.
9.2We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service solely for personal, non-commercial purposes.
9.3You may not copy, modify, distribute, sell, or commercially exploit any part of our intellectual property without our express written permission.
9.4This license terminates automatically if your access to the Service is suspended or revoked.
9.5Any content, feedback, or suggestions you voluntarily submit to us become our property, and we may use them for any purpose without restriction or compensation.

10. Information Security

10.1You are responsible for safeguarding your transaction information, including your HiFiSwap ID, transaction hashes, wallet addresses, and the email associated with your account. Do not disclose this information to anyone other than authorized HiFiSwap support staff.
10.2HiFiSwap will not proactively ask you for account credentials or sensitive personal data except to: (i) complete a transaction you initiated; (ii) handle a support inquiry; or (iii) fulfill legal compliance obligations such as AML/KYC.
10.3HiFiSwap is not liable for any loss arising from information you voluntarily submit through the website or contact channels, or from the transmission of information in response to requests we reasonably believe to be legitimate.

11. Limitation of Liability

11.1The Service is provided on an “As Is” and “As Available” basis. We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
11.2To the maximum extent permitted by law, HiFiSwap and its directors, officers, employees, and agents shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from the use of or inability to use the Service — including damages caused by reliance on platform information, system errors, computer viruses, transmission delays, or unauthorized access — regardless of the legal theory and whether or not we were advised of the possibility of such damages.
11.3Exchanges executed through the platform are irreversible. Please verify all transaction details carefully before confirming. Once crypto assets leave the platform, HiFiSwap assumes no responsibility for them and does not guarantee continuous availability of the Service.
11.4Our aggregate liability for all claims related to the Service shall not exceed the total fees you paid to HiFiSwap in the three (3) months preceding the event giving rise to the claim.
11.5HiFiSwap actively cooperates with law enforcement to combat fraud in the crypto-asset space. We reserve the right, at our sole discretion, to suspend or terminate any exchange we believe involves illegal activity, without prior notice and without any obligation to disclose our reasons.

12. Indemnification

You agree to indemnify, defend, and hold harmless HiFiSwap, its affiliates, and their respective directors, officers, employees, and agents from and against all third-party claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

12.1Your use of, or conduct in connection with, the Service;
12.2Any breach or alleged breach of the representations, warranties, or obligations set out in these Terms;
12.3Your violation of any applicable law, regulation, or third-party right;
12.4Any dispute between you and a third party arising from your exchange transactions.

If such a claim arises, HiFiSwap will notify you in writing and, at your expense, provide reasonable assistance with the defense. HiFiSwap reserves the right to assume exclusive control of the defense of any matter for which you are liable, in which case you agree to cooperate with our defense of the claim.

13. No Securities Offering

13.1HiFiSwap supports only crypto assets that have not been classified as securities by the U.S. Securities and Exchange Commission (SEC) or other competent regulators.
13.2The responsibility for confirming that a digital token or currency does not constitute a security rests with its holder. If there is reasonable doubt that a particular asset may be classified as a security, HiFiSwap reserves the right to delist it and discontinue support.
13.3Nothing in these Terms constitutes investment, financial, legal, or professional advice, nor any representation or warranty that any crypto asset offered through the Service is not a security.

14. Termination

HiFiSwap reserves the right to suspend or terminate your access to the Service and delete your account and registration data (including username and password) in the following circumstances:

14.1Service discontinuation — If we decide to stop providing the Service for any reason, we will give at least 3 calendar days’ written notice by email;
14.2Breach of the Terms — If we determine, at our sole discretion, that you have violated any provision of these Terms, we may suspend or terminate your access immediately without prior notice;
14.3Restricted Areas — If we determine that you are accessing the Service from, or are a resident of, a Restricted Area, we may suspend or terminate your account immediately without prior notice.

HiFiSwap has no obligation to disclose its reasons for any suspension or termination decision.

Upon termination of these Terms for any reason, Section 8 (Risk Disclosure), Section 11 (Limitation of Liability), Section 12 (Indemnification), and Section 15 (General Provisions) shall survive.

15. General Provisions

15.1Entire agreement — These Terms constitute the entire agreement between you and HiFiSwap regarding the Service and supersede all prior understandings and agreements.
15.2Conflicts — If these Terms conflict with another agreement between you and HiFiSwap, the terms of that agreement prevail only if it expressly states that it supersedes these Terms.
15.3No waiver — Our failure to exercise any right under these Terms does not constitute a waiver of that right.
15.4Severability — If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect.
15.5Assignment — You may not assign your rights or obligations under these Terms without our written consent. HiFiSwap may freely assign its rights under these Terms without your consent.
